fa بررسی معیارهای عدم مسئولیت پزشک از منظر رویه پزشکی قانونی Analyzing Indicators of Physicians non Responsibility in Forensic Precedent تخصصي Special پژوهشي Research ‌زمینه و هدف:  موضوع عدم مسئولیت در حوزه پزشکی از مباحث پیچیده و درعین‌حال کاربردی بوده که کمتر به آن پرداخته شده است، لذا در این مقاله کوشش شد تا با دقت در نظرات به دست آمده در پرونده‌های رسیدگی به تقصیر و تخلفات پزشکی، شاخص‌هایی را که از منظر کارشناسان بررسی‌کننده در عدم مسئولیت صاحبان حرف پزشکی مؤثر است مورد تجزیه‌وتحلیل قرار گیرد. مواد و روش‌ کار: مطالعه پیش‌رو به لحاظ هدف کاربردی، ازنظر شیوه تجزیه‌وتحلیل به روش توصیفی - تحلیلی، به لحاظ مقطعی به‌صورت گذشته‌نگر و ازنظر جمع‌آوری داده‌ها به‌صورت اسنادی و کتابخانه‌ای است. یافته‌ها: در تمامی مواردی که نتیجه‌ای غیر‌منتظره یا نامطلوب برای بیمار رخ می‌دهد، امکان طرح شکایت از پزشک وجود خواهد داشت. ولی همه این حالات را نمی‌توان ناشی از تقصیر پزشک دانست. اصولاً پس از به جریان افتادن چنین پرونده‌هایی و با توجه به جنبه تخصصی این امور، نیاز است تا نسبت به دریافت نظریه کارشناسی اقدام شود. سازمان پزشکی قانونی یکی از مراجعی است که در این زمینه یاری‌گر قضات است. استدلال‌های منعکس‌شده در این پرونده‌ها حاکی از آن است که هرگاه ضرر حاصله قابل انتساب به پزشک نبوده یا عوامل دیگر سبب قطع این رابطه شوند، مسئولیتی شکل نخواهد گرفت. بحث و نتیجه‌گیری: دقت در نظرات‌ گردآوری‌شده در پرونده‌های قصور پزشکی‌ روشن می‌سازد رعایت موازین علمی، ماهیت بیماری، فقدان رابطه ضروری میان آسیب و اقدامات پزشکی و کوتاهی یا تقصیر بیمار مهم‌ترین شاخص‌هایی‌اند که می‌توانند در عدم شناسایی مسئولیت ارائه‌دهندگان خدمات پزشکی نقش داشته‌باشند.بنابراین در وهله نخست رعایت موازین علمی و به‌کارگیری کوشش خردمندانه و متعارف می‌تواند در رفع مسئولیت پزشک اثرگذار باشد. بر پایه این معیار تا همین اندازه که پزشک با علم روز آشنا بوده، مرتکب تقصیر نگردیده، دقت کافی را در تشخیص بیماری به خرج داده و روش درمانی مناسبی را نیز با توجه به شرایط بیمار برگزیند برای عدم مسئولیت وی کفایت می‌نماید. در وهله دوم برخی از عوامل را می‌توان به‌عنوان عاملی خارجی یا قاهره فرض کرد که خارج از اراده ارائه‌دهندگان خدمات پزشکی بوده و ایشان دخالتی در تحقق یا پیدایش آن رخداد ندارند. از همین‌رو اگر عارضه غیرقابل‌پیش‌بینی و پیشگیری باشد یا قابلیت اصلاح داشته‌باشد رابطه سببیت  را قطع خواهد کرد.   <a name="_Toc416081061">Background & Aims: </a>Addressing the issue of liability in the field of medical topics that are complex, and functional. In this writing was attempts to consider cases dealing with medical negligence and violations, we try to analyse those faults and violations which give rise to non-responsibility of physicians. Materials & Methods: This is an functional study descriptive method of analysis which their data are collected through documentary studies. Findings:In all cases, that an unexpected or undesirable result occur for patient, there could be a case against doctors, but they are not necessary caused by their fault basically, after the opening of such cases obtaining experts opinions is necessary. Forensics is the most important authority in this area. The existing arguments in medical cases show that if the resulted harm can not be attributed to the doctors or the chain of causation is broken, there is no responsibility. Conclusion:The contemplation of the comment that are recorded in medical malpractice cases reveals that following scientific procedures, nature of disease, lack of causality between physicians maltreatment and  patients fault are the most important factors that lead to their authentication. So, first of all, observance of scientific standards and the use of reasonable and diligent efforts can be effective in removing the responsibility of the physician. Based on this criterion, to the extent that the physician is familiar with the science of the day, he has not committed a fault, he has sufficient accuracy in diagnosing the disease, and chooses the appropriate treatment according to the patient's conditions, for his lack of responsibility. In the second place, some factors can be considered as external factors or Cairo, which are beyond the control of the owners of medical matters and they do not interfere with the realization or occurrence.
